"SIMPLE" ASSAULT
California Penal Code §240 defines an "assault" as an "unlawful attempt" to commit a violent injury upon another person coupled with a present ability to do so. More simply, it means performing any act that is likely to result in the application of force to another person.
Since California assault law doesn't require any actual injury and often times it is one person's word against another's, it's easy for college students to be falsely accused of and arrested for assault.
"SIMPLE" BATTERY
California Penal Code §242 states that "battery" occurs when you deliberately and unlawfully use force or violence upon another. It does not matter whether there is any actual harm or injury the other person; some type of unwanted physical contact is all that is necessary.
